Terms & Conditions

These terms and conditions apply to the EiyoHub app for mobile devices, together with any related services, that was created by Cristian (the "Service Provider") as a Freemium service. By downloading or using the Application, you are agreeing to the following terms. Please read them carefully before proceeding. These Terms and any dispute arising out of them will be governed by the laws of Romania.

Intellectual Property Rights

The Application and all its contents, features, and functionality are the exclusive property of the Service Provider and its licensors. The Application is licensed to you, not sold. This license does not transfer any intellectual property rights to you. You may not copy, modify, distribute, sell, transfer, sublicense, or create derivative works based on the Application or its content.

Eligibility and Registration

The Application is intended for users who are at least 16 years old, or the higher age of digital consent established under applicable law. By registering, you represent that you meet these eligibility requirements.

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. If you suspect unauthorized access to your account, you must notify the Service Provider immediately at support@eiyohub.com.

Third Party Services

Please note that the Application utilizes third-party services that have their own Terms and Conditions. The Service Provider is not responsible for the terms, privacy practices, or conduct of any third-party service. By using the Application, you also agree to the terms of these third-party providers where applicable.

User-Generated Content

You may provide content to the Application (such as workout logs, food entries, and account information). You retain ownership of your content. By submitting content, you grant the Service Provider a non-exclusive, royalty-free license to use, process, and store your content solely to provide and improve the Application's services to you. The Service Provider does not claim ownership of your personal data or logs.

Prohibited Uses

You agree that you will not use the Application to:

• Violate any applicable law or regulation.
• Infringe the intellectual property or privacy rights of others.
• Reverse engineer, decompile, or disassemble the Application.
• Interfere with or disrupt the integrity or performance of the Application or its servers.
• Attempt to gain unauthorized access to any part of the Application or its related systems.
• Use the Application in any manner that could harm, disable, overburden, or impair it.
• Use the Application for commercial purposes without the Service Provider's express written consent.

Health and Medical Disclaimer

The Application provides general fitness, nutrition, and calorie information for informational purposes only. The Application is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. Information provided by the Application (including calorie estimates, macro targets, and workout suggestions) is not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified healthcare professional before starting any new diet, exercise, or fitness program, especially if you have or suspect a medical condition. Do not disregard or delay seeking professional medical advice because of information provided by the Application.

Internet Connection

Certain functions of the Application require an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot take responsibility for the Application not working at full functionality if you do not have access to Wi-Fi, and you have used up your data allowance.

If you are using the Application outside of an area with Wi-Fi, you should remember that your agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the Application, or other third-party charges.

Updates and Changes to the Application

The Service Provider may update the Application from time to time. The Application is currently available as per the requirements for the operating system (and for any additional systems the Service Provider decides to extend the availability of the Application to) and you need to update it if you want to keep using the Application. The Service Provider does not promise that it will always update the Application so that it is relevant to you and/or works with the operating system version that you have installed on your device.

However, you promise to always accept updates to the Application when offered to you. The Service Provider may also wish to stop providing the Application and may terminate use of it at any time without giving notice of termination to you. Unless the Service Provider tells you otherwise, upon any termination, the rights and licenses granted to you in these terms will end.

Limitation of Liability

To the fullest extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or personal injury, arising out of or in connection with your use of, or inability to use, the Application.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, the Service Provider's liability is limited to the maximum extent permitted by law.

Nothing in these Terms limits the Service Provider's liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

Warranty Disclaimer

The Application is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. The Service Provider does not warrant that the Application will be uninterrupted, error-free, or free of viruses or other harmful components. This warranty disclaimer does not apply where prohibited by applicable consumer protection law.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Application shall first be subject to good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in Romania.

If you are a consumer in the EU, you also have the right to submit a dispute to your local consumer dispute resolution authority or use the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr

Changes to These Terms and Conditions

The Service Provider may update these Terms and Conditions from time to time. You are advised to review this page periodically for any changes.

The Service Provider will notify you of material changes by posting the updated Terms with an effective date. Your continued use of the Application after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Application.
